The Parties
- “Syarah” (referred to as either "Company", "We", "Us" or "Our" in this Agreement) refers to Syarah Information Technology Company, registered in the Kingdom of Saudi Arabia under Company Registration No. 1010538980, under VAT number 310519294600003, and its offices registered at the following address:
42171 Khurais Road, Al-Naseem Al-Gharbi District, Unit No. 196, Riyadh 14231 - 7698. - “You” refers to the individual accessing or using the Service (“Website/Application”), including but not limited to placing a purchase order. It also refers to any other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Your Order
- Your purchase details are mentioned in the purchase order you placed through our Website/Application. Such details include but are not limited to, car specifications, price, and cost of other services related to the car you are purchasing.
- If the Company accepts your purchase order, you shall be notified by an SMS or a WhatsApp message.
- If your order conflicts with these Terms and Conditions, or in case of inconsistency or ambiguity, your order will take precedence .
- We are constantly trying to ensure the accuracy of all prices on our Website/Application. However, in case the Products available on our Service are mispriced, you shall be notified as soon as possible, and shall be given the choice to either reconfirm your order with the updated price or to cancel it. If we are unable to contact you, your order will be automatically canceled. In case you choose to cancel and have already made the payment, you will be fully refunded.

Binding Terms
- By using the services of Syarah, registering for, logging into your account at Syarah, or downloading and installing our app, you agree to be bound by these terms.

- You should print a copy of these terms for your records. If you do not agree with these terms, or the terms and services are not appropriate given your personal or financial circumstances, you should cease use of the services immediately and request the closure of your account.
- We reserve the right to change these terms at any time without notice to you by updating the app and our website to incorporate any new or amended terms. Any amendments to the terms will not alter the terms applicable to any purchase made using our services prior to the publication date of any new or amended terms unless we give you prior written notice. You are responsible for regularly reviewing information posted on our app or website to obtain timely notice of amendments to these terms. Your continued use of the services after amendments to these terms are published constitutes your acceptance of the amended terms.
Payment Options
- Your car is booked once you make a down payment using one of the following options: Mada, Visa, Master Card, PayPal, Apple Pay, Google Pay or a bank transfer.
- The following payment options are not accepted when placing your order on the Website/Application: cash or personal checks. Bank transfers are only available for specific types of transactions.
Prices
- The purchase price already includes the value-added tax (VAT), if any, at the current rate of 15% being charged in the Kingdom of Saudi Arabia on the date of purchase.

- Our used cars undergo over 200 mechanical and specification inspections as part of the sale preparation process.
- At “Syarah”, we offer you 3 years of free roadside assistance when buying a new car, or a free 1 year or 20,000 km warranty when buying a used car. Your direct contractual relationship will be with a third party that provides the warranty or the roadside assistance.
- You may choose to purchase an extended warranty by contacting “Syarah” customer service by phone at 920005379. If you purchase an extended warranty, your direct contractual relationship will be with the third party warranty provider.
- "Syarah" does not offer any warranty from the manufacturer of the used car. However, a new car will be under the standard manufacturer warranty.
- The used cars offered by us may have been used as rental cars or may have been owned by multiple owners. They may have been imported from another country. We will provide you with any additional information about the vehicle upon your request as practically possible. However, if you have any questions about the history of the vehicle or have specific requirements, you are advised to discuss these questions with us prior to placing your order.
- The actual mileage on the used car may differ slightly from that stated on the Website/Application. This discrepancy is due to the process of transporting the car to our refurbishment facilities, loading and delivering it to you.
- Car images on our Website/Application are for illustrative purposes only. Although we do our best to accurately display the car, we cannot guarantee that the images on the Website are an exact match to the actual appearance of the car. Although we do our best to accurately describe the color of the car, you may consider that the description of the color of the car differs from the actual appearance of the car. We do not guarantee that the color of the car exactly matches the description. If you believe that the car you have purchased differs from the one described on our Website/Application, you have the right to reject the delivery or to return the car and request a refund in accordance with these Terms.
- If prior to delivery or collection of your car, we identify a quality issue that we are unable to resolve or it is not practical for us to resolve (for example, it would be too expensive to fix), then “Syarah” may cancel your order after contacting you, before the vehicle is delivered or picked up. In this case, we will refund all payments received for the car (including any delivery fees you may have paid).
Cancellations and Refunds
“Syarah” may cancel your order in the following cases:
- We have tried to contact you by all available means, but with no response from your side. In this case, your order will be canceled. The down payment will be refunded to your used online payment card.
- We have confirmed the car reservation with you, have tried to contact you by all available means but with no response from your side. In this case, your order will be canceled. The deposit will not be refunded once the car has been confirmed and booked.
- “Syarah” may cancel your order at any time prior to delivery or collection of the car. If we do, we will refund all payments received for the car.
- If we find an error in the pricing of the car or services you have ordered. In this case, we will inform you as soon as possible and give you the option to either reconfirm your order at the correct price or cancel your order. We will be obligated to refund what you paid.

Collection and Delivery
If you choose to have your car delivered to your address:
- Syarah offers a car delivery service directly to your doorstep at the standard shipping cost for only 26 destinations, which include: (Riyadh, Qassim, Hail, Al-Ahsa, Dammam, Jubail, Khobar, Khafji, Hafar Al-Batin, Taif, Baha, Medina, Mecca, Jeddah, Yanbu, Abha, Muhayil Asir, Bisha, Najran, Namas, Jizan, Sabya, Arar, Sakaka, Tabuk, and Qurayyat). Additionally, we provide an express shipping option for all regions, cities, and villages across Saudi Arabia at an additional fee. Your car will be delivered on the date shown on your order document or bill of lading document, unless informed otherwise.
- You are the only one eligible to receive the car upon delivery.
- Delivery charges will be determined during order processing and will be confirmed with you prior to delivery.
- Your car will be delivered only to the location specified in your order.
- Upon receiving your car, you must present the following to the truck driver to verify your identity: your driver's license issued by the Kingdom of Saudi Arabia, your national identity card, or your residency card if you are a foreigner.
- If you need to change your delivery address, you should contact “Syarah” customer service by phone at 920005379.
- Upon delivery, you must sign our delivery receipt as provided by our delivery officer or truck driver, to confirm that you have received the car, and that it meets the specifications in your order.
- You may collect the car from the showroom where the car is located.
- You may collect the car on the date shown on your order document, unless we inform you otherwise.
- You are the only one eligible to collect the car.
- Upon receiving your car, you must present the following to the showroom employee, or “Syarah” customer care employee to verify your identity: your driver's license issued by the Kingdom of Saudi Arabia, your national identity card, or your residency card if you are a foreigner. We may refuse to allow you to collect the car if you do not provide this identification.
- When you collect your car, you must confirm receipt to the showroom employee or "Syarah" customer care employee. You must sign the receipt to confirm that you have received the car and that it meets the specifications in your order.
If you choose to collect your car from our locations:
Buy it used under warranty, try it for 10 days, return if it doesn’t suit you
- When you buy a used car from us under warranty, this allows you to return the car and get a full refund within 10 days, and for any reason.
- "Syarah" guarantees to fully refund your payment within 10 days from the date of receiving your car and for any reason. Yet we cannot accept the return of the car if it has been modified, damaged, had an accident, or is not in the same condition it was when delivered to you. There are no fees for returning the car, and the price you paid for the car will be refunded. This service aims to provide you with an easy and affordable way when you buy a used car directly.
- The car return warranty applies to cars owned by “Syarah” trading company only and does not include cars owned by exhibitions or individuals if their price exceeds 100,000 riyals (one hundred thousand Saudi riyals).
- The customer is obligated to deliver the car within 24 hours after accepting the return request for your order by the sales representative.
- The car value will be refunded within a period ranging from 14 to 28 days from the date of approval by the technical inspection department after receiving the car, excluding from the amount any additional purchases made by the customer (such as accessories).
Used Car Warranty Terms
To benefit from the warranty and maintain its validity, please read all the following instructions, controls, provisions, and exclusions mentioned in the warranty document.
First maintenance: one week after the document start date or 1000 km, whichever comes first.
Next maintenance: 3 months / 6 months or 5,000 / 10,000 km, whichever comes first, depending on the oil used.
- Language: The Arabic language is the reference and accordingly, all the terms and conditions of this guarantee are explained.
- Customer: The owner of the vehicle named on the customer data page.
- Repair Workshops: Periodic quick maintenance (oil changes, filters, fluid checks) must be performed at one of the following centers:
- Authorized dealer maintenance centers according to the car type.
- Express maintenance centers approved by "Syarah" (Petromin - One stop - AC Delco - Eni Neft - Mobil - Mlze - Total - Gulf - Dealership).
- Other express maintenance centers that give the customer an electronic invoice according to the instructions of the Ministry of Trade and Industry regulation, which must include the following:
- A computer-printed invoice.
- "Syarah" is notified within a maximum of 48 hours; otherwise, it will be considered a maintenance violation, and the warranty will be void. Mechanical failure: Any part of the covered parts of the vehicle fails to perform its work, causing the vehicle to stop functioning for reasons other than wear and tear caused by normal use (consumption) or misuse.
- Warranty Period: Starts from the date the customer receives the car and the warranty is issued.
- The warranty is considered void in the event of: Tampering with the vehicle’s kilometer odometer - if regular maintenance is not adhered to on-time - submitting a claim for repair based on a deception, whether regarding the value or the malfunction - if the repair is carried out based on a deception, whether the value or the malfunction - if the Repairing a defect covered by the warranty without obtaining prior approval from Syarah company.
- Scope of the program: During the use of the vehicle within the territory of the Kingdom of Saudi Arabia.
Very Important:
Please make sure to carry out regular maintenance in a timely manner - engine oil change - to preserve the validity of this warranty. Maximum coverage for each claim is 5,000 Riyals, with an unlimited number of claims.
General Definition:
Daman Plus program is a contract under which “Syarah Company” undertakes the cost of repairing the mechanical and electrical failures that occur to your car for the parts covered under this program and in accordance with the terms and conditions mentioned below and specified in the warranty document. Repairs are carried out at repair centers approved by "Syarah" and equipped to serve you in the best way possible.
Claims are not accepted until the customer has driven a distance of 1,000 KM from the mileage recorded in the warranty document for the car. Additionally, the warranty cannot be canceled or transferred to another car.
Please adhere to and comply with the regular maintenance procedures at the official dealer of the car or at the authorized centers by Syarah Company or at the express periodic maintenance centers that provide electronic invoices to the customer, according to the instructions of the Ministry of Commerce and Industry. It is important to note that the customer is responsible for the cost of regular maintenance. The initial periodic maintenance should be done within a week or 1,000 km, whichever comes first, from the date the customer receives the car and issues the subsequent periodic maintenance warranty every 3 or 6 months or (5000/10000 km), whichever comes first, according to the manufacturer's guidelines and the type of engine oil used.
Our authorized repair centers are spread across all cities and provinces of the kingdom. If your car breaks down, don't worry. You can easily reach us wherever you are. We have made it convenient for you to file your claim, and we will respond to you within a maximum of 12 working hours. You will receive a text message on your mobile phone with the response. If you have adhered to regular maintenance on time and the warranty covers the fault, you can expect approval.
Very Important:
Please adhere to and comply with the express periodic maintenance procedures (oil change, filters, fluid checks) on time to avoid invalidating the warranty. Also, make sure to keep the maintenance invoices for documentation purposes.
Exceeding one scheduled maintenance, whether in terms of mileage or warranty period or losing one maintenance invoice, renders this warranty void without any exception or condition.

Vehicle towing service: In the event of a mechanical or electrical breakdown that makes it impossible to operate or drive the vehicle in one direction.
- - Within cities: To any service center specified by the subscriber.
- - Outside cities: To the nearest city to the place where the car broke down, up to a maximum of (150 km).
Note:
- Services are not provided in the event of force majeure, natural disasters, the sinking of the platform, or its disruption in the sand, and the service is not provided after traffic accidents.
- Services are provided only in the presence of the vehicle owner or one of his authorized representatives, and the services cannot be transferred to another vehicle.
Warranty Coverage & Exclusions:
The warranty does not cover regular maintenance and consumable maintenance parts. This includes routine maintenance necessary for the vehicle's use and parts that are typically recommended for replacement.
Routine periodic maintenance, which includes fuel, oils, refrigerant, filters, spark plugs, coils, injector cleaning, belts, wipers, brake rotor resurfacing, battery, engine and transmission mounts, and other rubber parts that naturally wear out, as well as ball joint boots and all consumable parts, are not covered by the warranty.
This program does not cover other mechanical and electrical faults that are not included in this warranty and are not mentioned in the section specifying the parts covered by the warranty, as outlined above.
The exterior of the car includes the paint, doors and windows, door handles and hinges, car glass, mirrors, wipers, lights and signals, tires and wheels, tire sensors, sunroof, trunk, and accessories.
The interior accessories and decor of the car include sound systems and screens, navigation systems and their accessories, cameras, seats and armrests, airbags and cushions, lighting buttons and controls.
The immediate consequences of natural disasters, wars, accidents, and other events include drowning, floods, storms, earthquakes, accidents, and more.
The malfunctions that are directly caused by not adhering to regular maintenance include engine failure, transmission problems, brake issues, electrical system failures, and other mechanical breakdowns.
Tampering with the mileage odometer, whether by replacing, disconnecting, altering, or changing the reading, renders this warranty void.
This warranty does not cover oil and fluid leaks and deficiencies.
The warranty is considered void in case of misuse of the car or modifications to parts or the vehicle's body.
Any car used for hire or for hire (such as taxis, freight or delivery companies, driving lessons) or any car used in any type of competition, including rallying, racing, or drifting.

Note: Incompleteness of the required papers, the claim is considered unacceptable, and the company has the right to amend the above-mentioned papers according to the need.
If a claim is approved based on incorrectly submitted documents, Syarah Website Company has the right to demand that the customer pay the claim value and warranty cancellation.
- Buying your car through Lease Financing
- Syarah facilitates lease financing of cars via its financing and banking partners.
- Syarah does not directly finance the cars it sells.
- When buying a car via lease financing, Syarah sells the car to the financing institution and the customer leases or buys the car from the financing institution entity.
- The contract that the customer signs with the financing institution will govern the customer's relation with them. Syarah is not involved in this relation between the financing institution and the customer.

Force Majeure
- “Syarah” shall not be liable or responsible to the customer, nor be deemed to have defaulted under or breached these Terms and Conditions, when and to the extent such unfulfilled obligations are caused by or result from acts beyond our reasonable control, including, without limitation, the following (e.g fire, flood, strike, riot, disease, epidemic, accident, disruption of utility supplies or networks and systems, civil unrest, acts of terrorism or war, equipment failure, bad weather, acts and omissions of third parties, road traffic problems (each a “Force Majeure event”).
- In case of an event beyond our control that affects the fulfillment of our obligations:
- We will let you know as soon as we can;
- Our time to perform the affected obligations shall be extended as long as necessary until the termination of Force Majeure;
- We will rearrange any affected delivery and collection dates after the termination of Force Majeure.

Our Responsibility
- Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be limited by law, and nothing in these Terms will limit your legal rights. - We exclude all implied representations, warranties, terms and conditions (whether implied by legislation, common law or otherwise) to the maximum extent permitted by law.
- We shall have no liability to you (whether in agreement, tort (for example including but not limited to negligence), misrepresentation, breach of any obligation (including strict liability) or otherwise) as a result of: (a) any loss of profits or revenue; (b) loss of business; (c) loss of reputation; (d) data loss or corruption; or (e) any personal, indirect or consequential loss.
- Other than described above, “Syarah” shall not be liable for any amount in excess of the Aggregate Limit of Liability regarding your order, these Terms and Conditions howsoever arising (whether in agreement, tort (including but not limited to negligence), misrepresentation or breach (including strict liability) or otherwise), any fees will be limited to an amount equal to the retail price of the car and any additional products purchased as part of your order.
- You will indemnify us against all costs, expenses, liabilities and losses endured as a result of: (1) Your use of the Website or Application for any fraudulent or illegal purposes; and (2) Any third-party claims arising out of or in connection with your use of the Website or purchase of a car from the Website or Application.
- Registration Expiry: Syarah ensures the vehicle is delivered to the customer with a valid registration (i.e., not expired).
Consent to Security Interests of PFG
- Acknowledge and consent to security interests granted by Syarah in favour of Partners For Growth (PFG) in the Kingdom of Saudi Arabia over all its present and future rights, title and interest from time to time in and to all receivables, accounts payable, book and other debts, all proceeds and other rights to receive money under or in connection with these Terms and the Contract;
- Consent to the perfection and registration of such security arrangements over this agreement in the Unified Registry of Rights on Movable Assets, established and regulated in The Kingdom of Saudi Arabia, and includes any replacement or successor register;
- Consent to the exercise by PFG (or any receiver or delegate) of any of its rights under such security arrangements;
- Agree that you will pay any amounts owing as such fall due under this agreement as directed from time to time by PFG in writing; and
- Agree that you will not claim or exercise any right of set-off or counterclaim in respect of this agreement.
General Conditions
- If any of these Terms in whole or in part, is deemed illegal, invalid or unenforceable, by any court of competent jurisdiction, this will not affect the validity of the remaining Terms which will remain valid and enforceable to the maximum extent permitted by law.
- We shall be allowed to delegate our rights and obligations under these Terms to another entity, but this will not affect your rights or our obligations under these Terms.
- Your order, and these Terms and Conditions constitute the entire agreement and understanding between you and “Syarah” with respect to one subject matter, and shall negate any prior agreement or understanding between you and “Syarah” with respect to the subject matter of these Terms. You acknowledge that you have not stepped into these Terms as a result of any representation or warranty not clearly specified in these Terms and are not entitled to any remedies with respect to any representation or warranty not clearly specified in these Terms (except for any fraudulent misrepresentation).
- These Terms and Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation, shall be governed by, and construed in accordance with, the laws of the Kingdom of Saudi Arabia. Each Party irrevocably agrees that the courts of the Kingdom of Saudi Arabia shall have exclusive jurisdiction to settle any dispute or claim.
